Efforts to address child trafficking require intensive collaboration among professionals of varied disciplines. Healthcare professionals have a major role in this multidisciplinary approach. Training is essential for all professionals, and policies and protocols may assist in fostering an effective, comprehensive response to victimization.

The history of the continuous inclusion of mathematics in liberal education in the West, from ancient times through the modern period, is sketched in the first two sections of this chapter. Next, the heart of this essay (Sects. 3, 4, 5, 6, and 7) delineates the central role mathematics has played throughout the history of Western civilization: not just a tool for science and technology, mathematics continually illuminates, interacts with, and sometimes challenges fields like art, music, literature, and philosophy – (...) subjects now universally considered to be liberal arts. Section 8 adds an international perspective to the contemporary liberal arts story by describing some instructive mathematical achievements from many cultures and societies. Finally, Sect. 9 addresses how contemporary mathematics teaching can use the history of mathematics viewed as a liberal art to enhance the appreciation and understanding of mathematics for all students. Our thoughts, feelings, and behaviors are shaped in critical ways by our beliefs about how we compare to other people. Prior research has predominately focused on the consequences of believing oneself to be better than average (BTA). Research on the consequences of worse-than-average (WTA) beliefs has been far more limited, focusing mostly on the downsides of WTA beliefs. In this paper, we argue for the systematic investigation of the possible long-term benefits of WTA beliefs in domains including motivation, task performance, (...) and subjective well-being. We develop a conceptual framework for examining these possible benefits, we explore the usefulness of this framework to generate novel insights in an important psychological domain (skill learning), and we conclude with broader recommendations for research in other domains such as friendship formation, moral, and political decision making. This article examines the nature of affective states across biological taxa. It argues that affect constitutes a primary form of consciousness. Creatures capable of affect are sentient of their bodily states and can behave in ways intended to maintain or restore them to a homeostatic range. After reviewing and critiquing neurobiological and philosophical theories of the evolution of consciousness, this article argues that some possible creatures are limited to self‐directed affective states, even if those creatures are capable of exteroception. We examined the “othering” of Asian Americans in the context of the COVID-19 pandemic. Given past evidence that pathogen-related threat perceptions can exacerbate intergroup biases, as well as salient public narratives blaming the Chinese for the pandemic, we assessed whether individuals experiencing a greater sense of threat during the pandemic were more likely to apply the “perpetual foreigner” stereotype to Asian Americans. Over a seven-week period, we recruited 1,323 White Americans to complete a measure of the perceived Americanness of Asian, (...) Black, and White targets. Asian targets were consistently perceived as less American than White targets, across variations in subjective health threat and regional case counts. The direct and indirect connections of political ideology to the observed patterns were examined, revealing that White participants who blamed China for the pandemic were more likely to apply the perpetual foreigner stereotype to Asian Americans. These results indicate that the othering of Asian Americans is pervasive among White Americans and that variables related to social conditions surrounding the COVID-19 pandemic can predict the potency of this association. Emotion Review, Volume 14, Issue 1, Page 43-54, January 2022. This article reviews literature in composition studies since affective science's emergence in the 1980s. It focuses on composition studies’ history of adopting findings and theories from affective science, and distinguishes trends in how the field applies those elements in theoretical versus pedagogical contexts. While composition studies’ adoption of affective science in its theorizing has helped the field progress toward a “complete psychology of writing,” affective science's influence on classroom practices has (...) not been so clear cut or direct. However, affective science is a fast-growing, liberal, and multidisciplinary field. As it progresses, composition studies continues to embrace its concepts and theories. This review notes the expectations and limitations developing through this dynamic interdisciplinary relationship. (shrink)

The health of a nation tells much about the nature of a social contract between citizen and state. The way that health care is organised, and the degree to which it is equitably accessible, constitutes a manifestation of the effects of moments and events in that country's history. Research around health inequalities often focuses on demonstrating current conditions, with little attention paid to how the conditions of inequality have been achieved and sustained. This article presents a novel approach to inequalities (...) research that focuses on examining powerful historical discourses as legitimising processes that serve to sustain unequal conditions. The use of this Foucauldian historical genealogical approach in a study of the Irish health care system is explored and proposed as a novel approach to the research of health inequities. (shrink)

Responding to recent concerns about the reliability of the published literature in psychology and other disciplines, we formed the X-Phi Replicability Project to estimate the reproducibility of experimental philosophy. Drawing on a representative sample of 40 x-phi studies published between 2003 and 2015, we enlisted 20 research teams across 8 countries to conduct a high-quality replication of each study in order to compare the results to the original published findings. We found that x-phi studies – as represented in our sample (...) – successfully replicated about 70% of the time. We discuss possible reasons for this relatively high replication rate in the field of experimental philosophy and offer suggestions for best research practices going forward. (shrink)

Social norms – rules governing which behaviours are deemed appropriate or inappropriate within a given community – are typically taken to be uniquely human. Recently, this position has been challenged by a number of philosophers, cognitive scientists, and ethologists, who have suggested that social norms may also be found in certain non-human animal communities. Such claims have elicited considerable scepticism from norm cognition researchers, who doubt that any non-human animals possess the psychological capacities necessary for normative cognition. However, there is (...) little agreement among these researchers about what these psychological prerequisites are. This makes empirical study of animal social norms difficult, since it is not clear what we are looking for and thus what should count as behavioural evidence for the presence (or absence) of social norms in animals. To break this impasse, we offer an approach that moves beyond contested psychological criteria for social norms. This approach is inspired by the animal culture research program, which has made a similar shift away from heavily psychological definitions of ‘culture’ and to become organized around a cluster of more empirically tractable concepts of culture. Here, we propose an analogous set of constructs built around the core notion of a normative regularity, which we define as a socially maintained pattern of behavioural conformity within a community. We suggest methods for studying potential normative regularities in wild and captive primates. We also discuss the broader scientific and philosophical implications of this research program with respect to questions of human uniqueness, animal welfare and conservation. (shrink)

With the increasing professionalization of clinical ethics, some hospitals and health systems utilize both ethics committees and professional clinical ethicists to address their ethics needs. Drawing upon historical critiques of ethics committees and their own experiences, the authors argue that, in ethics programs with one or more professional clinical ethicists, ethics committees should be dissolved when they fail to meet minimum standards of effectiveness. The authors outline several criteria for assessing effectiveness, describe the benefits of a model that places primary (...) responsibility for ethics work with professional clinical ethicists—the PCE-primary model, and offer suggestions for alternative ethics program structures that empower healthcare professionals to contribute to ethics work in ways more tailored to their strengths and skills while minimizing the shortcomings of ethics committees. Greek, Roman and Byzantine Monographs, 1993. xii + 171 pp. 3 figs. 19 pls.The sacred law receiving its editio princeps in this monograph was a gift to the Getty Museum whose curator asked the authors to publish it. Since the Museum does not exhibit material of chiefly (...) historical interest, it donated the inscription to the Republic of Italy in 1992. The law is inscribed on the largest lead tablet known to the authors (0.597 x 0.23 x 0.002 m.). The tablet is broken on all sides; its text is written in two columns, A and B, upside down to one another. From the letter forms, and the mention of Zeus Meilichios and the proper name Myskos the authors infer Selinous as the place of provenience. A comparison of the letter forms with those of other inscriptions from the region suggests the mid–fifth century B.C. or slightly earlier as the date of the document. The dialect is a variety of West Greek, agreeing with the language of Megara Nisaia and its colonies. All this is set forth in exemplary fashion in Chapters I and II, along with a transcription and translation of the text accompanied by an extensive commentary with thorough and generally very enlightening discussion of all aspects of the law.The inscription is unlike most sacred laws in that it sets out proper ritual procedure rather than regulating cult finances or the perquisites of officials. The two parts, A and B, share a concern with purification, with A concentrating on sacrifice and giving instructions to a group, while B addresses one person seeking purification. Other rituals mentioned include libations, aspersions, anointing, turning around, and setting out a table and couch, which last the authors interpret as a θεοξενία. These matters and much more are expounded with acuity and a wealth of supporting evidence in Chapters III–VIII, which form the bulk of the book and contain much interesting information more or less closely related to the law. A summary of the evidence assembled in the commentary is followed by a close study of the various rituals (III, IV). In this essay, I draw on Kant’s legal philosophy in order to defend the right to voluntary motherhood by way of abortion at any stage of pregnancy as an essential feature of women’s basic rights. By developing the distinction between innate and acquired right in Kant’s legal philosophy, I argue that the viability standard in US law (as established in Planned Parenthood v. Casey) misunderstands the nature of embodied right. Our body is the site of innate right; it is the (...) means through which we can set and pursue ends in the world. The law, therefore, cannot adjudicate the relationship between the will and the body: it cannot require us to allow our bodies to be used against our will. By comparing unwanted pregnancy to sexual assault, I problematize the notion that consent to pregnancy, like consent to sex, can ever be conclusive. I examine Kant’s own account of unwanted pregnancy, in which he describes mother and child finding themselves “in a state of nature” in order to rethink the status of the fetus in law, and I argue that we should understand the fetus’s right to life as provisional, rather than as enforceable by law. Free speech has historically been viewed as a special and preferred democratic value in the United States, by the public as well as by the legislatures and courts. In 1937, Justice Benjamin Cardozo wrote in Palko v. Connecticut that protection of speech is a “fundamental” liberty due to America's history, political and legal, and he recognized its importance, saying, “[F]reedom of thought and speech” is “the matrix, the indispensable condition, of nearly every other form of freedom.” It is likely notable (...) that in the Bill of Rights free speech is protected in the First Amendment rather than later. This paper is about David Gauthier’s concept of constrained maximization. Attending to his most detailed and careful account, I try to say how constrained maximization works, and how it might be changed to work better. In section I, that detailed account is quoted along with amplifying passages. Difficulties of interpretation are explained in section II. An articulation, a spelling out, of Gauthier's account is offered in section III to deal with these difficulties. Next, in section IV, constrained maximization thus articulated (...) is tested on several choice problems and shown to be seriously wanting. It appears that there are prisoners’ dilemmas in which constrained maximizers would not cooperate to mutual advantage, but would interact sub-optimally just as straight-maximizers would. ‘Coordination problems’ are described with which constrained maximizers might, especially if transparent to one another, not be able to cope–problems in which they might not be able to make up their minds to do anything at all. And I prove that there are prisoners’ dilemmas that, though possible for real agents and for straight maximizers, are not possible for constrained maximizers, so that agents’ internalising dispositions of constrained maximization could not be of help in connection with such possibly impending dilemmas. Taking constrained maximization as it stands, there are many problems for which it does not afford the ‘moral solutions’ with which Gauthier would have it replace Hobbesian political ones. After displaying these shortcomings of constrained maximization as presently designed, I sketch, in section V, possible revisions that would reduce them, stressing that these revisions would not be cost-free. Whether finishing the job of fixing up and making precise constrained maximization would be worth the considerable trouble it would involve lies beyond the issues taken up in this paper. Suppose we agree to reject the view that privacy has narrow scope and consequently is irrelevant to the constitutional privacy cases. We then have (at least) these two options: (1) We might further emphasize and draw out similarities between tort and constitutional privacy claims in order to develop a notion of privacy fundamental to informational and Fourth Amendment privacy concerns as well as the constitutional cases. We can cite examples indicating this is a promising position. Consider consenting homosexuality conducted in (...) one's home, for instance. We view it as a private matter, whether the state is seeking to regulate the behavior, or if others are attempting to gain or exploit information about it. I believe basic conceptual similarities between tort and constitutional interests can be identified by showing that there is a range of similar reasons for protecting both tort and constitutional privacy concerns. We might worry, however, that a comprehensive concept of privacy may be too general to be very useful, given that privacy violations can be so diverse, and can arise, for example, from misuse of confidential information, from conduct that is intrusive even if no information is gained or disclosed, from disturbance of an intimate relationship, or from disruption of various other important aspects of one's life.(2) We could concede that whatever “privacy” means in the tort and Fourth Amendment cases, it means something different in the constitutional cases. Nevertheless, we might take that “something else” seriously as a distinct but legitimate use of the term which is not “spurious” but is reflected in our ordinary language. This appears to me to be a fruitful alternative. After all, contrary to Henkin's view that tort privacy is “what most people mean by privacy,” the term is often used in contexts beyond informational privacy and clearly related to the interests at stake in the constitutional cases. Thus, for example, in a pamphlet explaining how to protect children by teaching them how to say “No!” to strangers without making them paranoid or antisocial, parents and teachers are told, Children have a right to privacy. Teach it. Reinforce it. One of the ways to help children prevent sexual assault is to encourage them to develop a sense of physical integrity. A sense that they have a right to their own body space and privacy. Just as we allow them to close the door when they use the bathroom, we must allow them to say no to any unwanted physical affection and touch. Unfortunately, the most obvious starting point for identifying the sense of private relevant to the constitutional cases is extremely worrisome. The Court itself has said ... only personal rights that can be deemed “fundamental”...are included in this guarantee of personal privacy...the right has some extension to activities relating to marriage...procreation...contraception...family relationships... and child rearing and education.Roe v. Wade, 410 U.S. 113 (1973).The difficulty, of course, is that little more is offered by way of explanation of which rights are “personal” or “fundamental” or both. Focusing on marriage makes Roe v. Wade difficult to understand given that Ms. Roe was unmarried, and attending only to family issues does not help us make sense of the Stanley case protecting one's right to view pornography in one's home. It is perhaps more problematic that decisions such as what color shoes to wear are reasonably viewed as personal, yet are far from fundamental enough to warrant protection. And regulations governing the draft and employment, for example, are not viewed as privacy invasions although they might be said to interfere with matters of one's life that are both fundamental and personal in the vague sense described.Before we give up in frustration, however, I would urge that we recall that even in tort law the notion of privacy has been evolving through a constellation of judgments. Although there is no fixed way of using the term which we then proceed to analyze, the concept of privacy has not in those cases been taken to be meaningless or empty. Similarly, there is reason to believe that the scope of a “personal and fundamental” notion of privacy relevant to the constitutional cases can be further delineated through a consideration of cases, especially since it seems to me that in many cases application of the term is clear and unproblematic. A decision to have a vasectomy, for example, can uncontroversially be said to be a personal and fundamental one, and it is in that sense private. We fail to acknowledge the personal significance in an individual's life of forcing or refusing him the operation if we deny that this important sense of privacy is relevant to such a decision merely because an interest in determining for oneself what one ought to do is also at risk.Of course, once it is settled that something is a private matter, it is a separate issue to decide whether or not, in some social context, an invasion of it can be justified. Thus, I would claim, a mandatory sterilization program for male recidivists or for those in a country suffering grave poverty and overpopulation does invade privacy, and the social or legal question is whether or not the invasion can, in the particular circumstances, be justified. Although all will agree that both individual and social interests must be balanced by moral philosophers as well as the courts, in conflicts we will not always agree on the weight to be accorded individual claims.I have not provided a constitutional defense for citing privacy as one right at stake in the constitutional privacy cases. Nor have I attempted to enter the debate about how strictly to interpret the Constitution. But if I am correct, then we can agree there is an important interest in privacy at issue in those cases without merely conflating privacy and autonomy or liberty, and can continue the process of marking out its boundaries. If we reach such agreement, we will have made considerable progress. Moreover, the implications of this view are significant. Current constitutional standards, controversial though they may be, require “strict scrutiny” for cases concerning “fundamental values,” and privacy has been judged to be one such value. Thus these privacy claims have a greater chance of being protected when they conflict with other rights or general interests than they would have if only liberty, or freedom from governmental interference, were involved. It is the purpose of this note to comment on some important problems which have been already vividly discussed by several authors. Besides the well known former discussions of Schrödinger and J. v. Neumann I should like to mention here especially H. Margenau's article, “Critical Points in Modern Physical Theory,” which strongly influenced my present discussion.

It is being increasingly recognized that the Saussurean dictum of “the arbitrariness of the linguistic sign” is in conflict with the pervasiveness of the phenomenon commonly known as “sound symbolism”. After first presenting a historical overview of the debate, however, we conclude that both positions have been exaggerated, and that an adequate explanation of sound symbolism is still lacking. How can there, for example, be (perceived) similarity between expressionsand contents across different sensory modalities? We offer an answer, based on the (...) Peircian notion of iconic ground, and G. Sonesson’s distinction betweenprimary and secondary iconicity. Furthermore, we describe an experimental study, in a paradigm first pioneered by W. Kohler, and recently popularized by V.Ramachandran, in which we varied vowels and consonants in fictive word-forms, and conclude that both types of sounds play a role in perceiving an iconic ground between the word-forms and visual figures. The combination of historical conceptual analysis, semiotic explication and psychological experimentationpresented in this article is characteristic of the emerging paradigm of cognitive semiotics. During the last years, there has been an increasing discussion on the role of business in human rights violations and an increase in human rights litigation against companies. The result of human rights litigation has been rather disillusioning because no corporation has been found guilty and most cases have been dismissed. We argue that it may nevertheless be a useful instrument for the advancement of the business and human rights agenda. We examine the determinants of successful human rights litigation in (...) terms of judicial, educational, and regulatory effects. This article reviews more than 40 corporate foreign direct liability cases and their effects on corporate human rights policies and conduct. The review shows that most corporations adjusted their human rights policies and adopted additional measures to cope with human rights issues during or shortly after the legal proceedings. Opening legal channels for human rights litigation may be one way for governments to incentivize firms to respect human rights. These findings have implications for the United Nations Guiding Principles on Business and Human Rights as well as on our interpretation of the most recent U.S. Supreme Court decision in Kiobel v. "Capital is a semiotic operator": this assertion by Félix Guattari is at the heart of Maurizio Lazzarato's _ Signs and Machines_, which asks us to leave behind the logocentrism that still informs so many critical theories. Lazzarato calls instead for a new theory capable of explaining how signs function in the economy, in power apparatuses, and in the production of subjectivity. Moving beyond the dualism of signifier and signified, _Signs and Machines_ shows how signs act as "sign-operators" that enter directly (...) into material flows and into the functioning of machines. Money, the stock market, price differentials, algorithms, and scientific equations and formulas constitute semiotic "motors" that make capitalism's social and technical machines run, bypassing representation and consciousness to produce social subjections and semiotic enslavements. Lazzarato contrasts Deleuze and Guattari's complex semiotics with the political theories of Jacques Rancière, Antonio Negri and Michael Hardt, Paolo Virno, and Judith Butler, for whom language and the public space it opens still play a fundamental role. Lazzarato asks: What are the conditions necessary for political and existential rupture at a time when the production of subjectivity represents the primary and perhaps most important work of capitalism? What are the specific tools required to undo the industrial mass production of subjectivity undertaken by business and the state? What types of organization must we construct for a process of subjectivation that would allow us to escape the hold of social subjection and machinic enslavement? In addressing these questions, _Signs and Machines_ takes on a task that is today more urgent than ever. (shrink)
